For purposes of clarification, any information which cannot be reasonably related to a discrete individual (such as aggregated statistical information) is not Personal Information.
Purposes for collection, use, and disclosure
The Genesis Parties collect, use and disclose your Personal Information in its normal course of business for the following purposes:

Registration. If you register for an account with our Services, we may collect your name, account credentials, contact information, demographic information and billing information, including email and physical address, username, password and payment card information.
We use this information to administer your account, provide you with the relevant Services and information, communicate with you regarding your account and your use of the Services, and for customer support purposes. Please note that we work with third-party payment processors for the collection and use of payment card information and do not receive such data directly.
Communications. If you communicate with us through any paper or electronic form, we may collect your name, email address, mailing address, cell phone number, or any other Personal Information you choose to provide to us.

The Site uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help websites analyze how users use the site. The information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the applicable Site, compiling reports on website activity, and providing other services relating to website activity and internet usage for a Genesis Party. The major browsers have attempted to implement the draft “Do Not Track” (“DNT”) standard of the World Wide Web Consortium (“W3C”) in their latest releases. As this standard has not been finalized and is not generally accepted across businesses, the Sites are not compatible with DNT. Additionally, since we do not deploy third party cookies for purposes of cross contextual behavioral advertising, the Site does not respond to Global Privacy Control signals, or similar browser settings.

When you visit our Sites, we collect your Internet Protocol (“IP”) addresses to track and aggregate visitor behavior. For example, we use IP addresses to monitor the regions from which users navigate the Sites.
An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded from our web server (or a third party service provider), is active only while you are connected to the Site, and is deactivated or deleted thereafter.
An Etag or entity tag is a feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. If the resource content at that URL ever changes, a new and different ETag is assigned. Used in this manner ETags are a form of device identifier. Use and Disclosure of Personal Information
We use and disclose Personal Information as described in this Policy. Generally, we use Personal Information for the following purposes, including:

In the normal course of performing services for our clients, Personal Information may be shared among Genesis Parties for research and statistical purposes, corporate record keeping and administration, system administration, joint marketing, providing you products or services, and crime prevention or detection.
Service Providers
Because a number of the service providers we use are located in the United States, your Personal Information may be processed and stored inside the United States, and the U.S. government, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your Personal Information under US laws.
In addition, generally, we will only provide your Personal Information to our lawyers, accountants, tax consultants and employees for the purpose of conducting our business and providing you with products or services. Our service providers adhere to the same protections regarding the collection, use, and retention of data as we do.
Business Transactions
As we continue to develop our business, we might sell or buy assets. In such transactions, user information, including Personal Information, generally is one of the transferred business assets. Also, if a Genesis Party itself or substantially all of a Genesis Party’s assets were acquired, your Personal Information may be one of the transferred assets. Therefore, we may disclose and/or transfer your Personal Information to a third party purchaser in these circumstances.
Other Legally Required Disclosures
The Genesis Parties reserve the right to disclose, without your prior permission, any Personal Information about you or your use of the Site if the Genesis Party has a good faith belief that such action is necessary to: (a) protect and defend the rights, property or safety of a Genesis Party, a Genesis Party’s employees, other users of the Site, or the public; (b) enforce the terms and conditions that apply to use of the Site; (c) as required by a legally valid request from a competent governmental authority; or (d) respond to claims that any content violates the rights of third-parties. We may also disclose Personal Information as we deem necessary to satisfy any applicable law, regulation, legal process, or governmental request.
Third Party Links
In some instances, Genesis may provide links to non-Genesis controlled services. However, Genesis does not control such third-party services, and cannot be responsible for the content or the privacy practices employed by other services or websites.
State Privacy Rights
Residents of some states in the US have certain rights, under the specific state law, as it relates to how their Personal Information is handled. These are the “right to know”, the “right to correct”, the “right to delete”, and the “right to opt-out”.

Right to Correct. You have the right to request we correct any personal information which is incorrect. Note that the right of correction is limited to information that is objectively incorrect, or where there is no legal obligation to retain “incorrect” data.
Right to Delete. Some state law gives its residents a limited right to request deletion of their Personal Information. However, this right is limited by a number of exceptions. Fundamentally, if we have a permissible need to retain Personal Information, we are not under an obligation to delete such information, even when requested. Safeguards will vary depending on the sensitivity, format, location, amount, distribution and storage of the Personal Information. 2. How Genesis Obtains Your Consent
Genesis sends text messages only to consumers who have consented to be contacted by text at the mobile number we have on file. Consent may be obtained in either of the following ways.
2.1 Consent You Provide Directly to Genesis
Genesis obtains your prior express written consent to send automated and AI-generated text messages through the following methods.
Method 1 — During an Automated Phone Call (DTMF Keypress)
When you receive an automated call from Genesis, our system may ask whether you would like to receive a secure link or account communication via text message. If prompted, you will hear a disclosure substantially as follows:
"Before I send you that link, I want to let you know that by pressing 1, you are providing your prior express written consent to receive automated and AI-generated text messages from Genesis regarding the collection and servicing of your account. You may receive up to 6 messages per month. Message and data rates may apply. Consent is not required to resolve your account. To provide your consent and receive the secure link, press 1. To decline, press 9."
By pressing 1, you are providing your prior express written consent to receive automated and AI-generated SMS messages from Genesis as described on this page. Your keypress response is recorded and time-stamped as documentation of your consent.
Method 2 — SMS Reply Opt-In
If you receive an opt-in text message from Genesis inviting you to enroll in the SMS program, you may reply YES to provide your prior express written consent. The opt-in message will appear substantially as follows:
"Reply YES to consent to automated/AI-generated texts from Genesis re: your account (up to 6/mo). Msg & data rates apply. Consent is not required to resolve your account. Reply STOP to opt out."
By replying YES, you are providing your prior express written consent to receive automated and AI-generated SMS messages from Genesis as described on this page.
2.2 Consent Provided When Your Account Was Established
In some cases, you provided your mobile telephone number and agreed to be contacted at that number by the original creditor, property owner, or property manager at the time your account was established (for example, on a rental application, lease agreement, resident portal, or similar document). When your account is placed with Genesis for collection or servicing, that contact information and the associated consent are provided to Genesis by our client. Genesis may send text messages to a mobile number obtained in this manner regarding the collection and servicing of your account.
2.3 Applies to All Consent Methods
Your consent to receive text messages is not required to purchase any goods or services, and is not required to resolve, settle, or otherwise address your account with Genesis. You may decline to consent or opt out at any time without affecting your account status or any rights you have under applicable law. Regardless of how your consent was obtained, you may opt out at any time using any of the methods described in Section 3, How to Opt Out. Your consent to receive text messages is never required to resolve, settle, or otherwise address your account with Genesis.
You may withdraw your consent and stop receiving SMS messages from Genesis at any time using any of the following methods:

Reply STOP — Reply STOP, QUIT, CANCEL, END, or UNSUBSCRIBE to any text message from Genesis. You will receive one final confirmation message, and no further messages will be sent to your number.

After opting out, Genesis will cease sending automated SMS messages to your number. Opting out of SMS communications does not affect Genesis's right to contact you through other means permitted by applicable law, including phone calls and written correspondence.

After opting out, Genesis will cease sending automated SMS messages to your number. If you revoke consent by replying STOP or through any of the methods above, Genesis will treat your request as a revocation of your consent to receive both automated and AI-generated text messages and automated and AI-generated telephone calls, unless you tell us that you wish to continue receiving one of them. Opting out of SMS communications does not affect Genesis's right to contact you through other means permitted by applicable law, including written correspondence and telephone calls that do not require your consent.
Re-Enrollment: If you have previously opted out and wish to re-enroll in the SMS program, you may do so by using one of the opt-in methods described in Section 2.1 above.

Genesis is committed to protecting your privacy. This section describes how we collect, use, and share information in connection with our SMS program.
In connection with the SMS program, Genesis collects your mobile phone number, your consent status (whether you have opted in or opted out), the date and time of your consent, the method by which consent was obtained, and, where applicable, the version of the consent disclosure presented to you.
How We Use Your Information
Your mobile phone number and consent information are used solely to deliver SMS communications related to the collection and servicing of your account, and to maintain records of your consent status as required by applicable law.
How We Share Your Information
Genesis will not sell, rent, or disclose your SMS opt-in information or consent status to third parties for marketing purposes.

6. Changes to These Terms
Genesis may update these Terms and Conditions from time to time. The current version will always be posted on this page, and the effective date at the top of the page will reflect the date of the most recent update. Changes become effective when posted. Where notice of a change is required by applicable law, Genesis will provide notice in the manner required.
We encourage you to review this page periodically. Your continued participation in the SMS program after an updated version is posted constitutes your acceptance of the revised Terms and Conditions. If you do not agree to the revised terms, you may opt out at any time by replying STOP to any text message from Genesis, or by using any of the other opt-out methods described in Section 3.
If Genesis materially changes the nature or purpose of the text messages you receive, Genesis will request your consent again before sending messages under the revised program.
7. Limitation of Liability
Genesis is not responsible for delayed or undelivered messages caused by your mobile carrier, network outages, or other technical circumstances outside of our control. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed by Genesis or by any participating carrier.
Nothing in these Terms and Conditions limits Genesis's obligations to consumers under applicable federal or state law, including the FDCPA and the TCPA.
